PLEASE READ THESE TERMS CAREFULLY BEFORE DEPLOYING WURFLRTD.

By deploying the WurflRTD module on your website — including by including it in a Prebid.js configuration — you (“Publisher” or “you”) agree to be bound by these Terms of Service (“Terms”). If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

If you do not agree to these Terms, you must not deploy WurflRTD.

These Terms govern your use of the WurflRTD module and associated services, including WURFL.js, the beacon analytics infrastructure, and any dashboard or reporting tools made available to you (together, the “Service”). The Service is provided by ScientiaMobile Inc., a corporation incorporated in the State of Delaware, USA, with principal offices at 12110 Sunset Hills Road, Suite 600, Reston, VA 20190 (“ScientiaMobile,” “we,” “us,” or “our”).

1. THE SERVICE

1.1 What WurflRTD Does

WurflRTD is a Real-Time Data (RTD) module for Prebid.js. When deployed on your website, it enriches programmatic advertising bid requests with device intelligence data — including device type, make, model, operating system, and screen properties — derived from the visiting user’s HTTP headers. This enrichment is passed to supply-side platforms (SSPs), demand-side platforms (DSPs), and other bidders participating in header bidding auctions on your website with the goal of improving advertising yield. As part of its operation, WurflRTD loads WURFL.js, ScientiaMobile’s device detection library, which makes accurate device capability data available directly in the browser.

1.2 Reliance on WURFL.js

The Service relies on WURFL.js, ScientiaMobile’s device detection technology, to identify device capabilities. By deploying WurflRTD, you also accept the terms of the WURFL.js Business Edition Terms of Service, available at https://www.scientiamobile.com/terms-of-service-wurfl-js-business-edition/ , as they apply to the underlying WURFL.js component. In the event of any conflict between those terms and these Terms with respect to WurflRTD specifically, these Terms shall prevail.

1.3 Three-Party Nature of the Service

You acknowledge that the Service is designed to transmit device data not only within your own website environment but also to third-party bidders participating in header bidding auctions. This is the core function of WurflRTD. By deploying the Service, you expressly authorize ScientiaMobile to enrich bid requests sent to those third parties as part of normal service operation.

2. ACCESS TIERS AND QUOTAS

2.1 Free Access

The Service is available to all publishers without registration or payment, subject to usage limits that ScientiaMobile may set and adjust at its discretion. ScientiaMobile reserves the right to suspend enrichment for any publisher whose usage exceeds applicable limits until the following calendar month. Beacon data collection (Section 4) continues during any suspension period.

2.2 Commercial Access

Commercial offerings with higher usage limits, expanded capability sets, and additional features are available by contacting ScientiaMobile. Commercial access requires a separate agreement.

3. AUTO-ONBOARDING AND ACCOUNT REGISTRATION

3.1 Auto-Onboarding

Publishers deploying the free tier are not required to register an account with ScientiaMobile prior to deployment. By embedding WurflRTD in your Prebid.js configuration, you are automatically onboarded and your domain is recognized by the Service. Acceptance of these Terms occurs at the point of deployment.

3.2 Usage Tracking

Regardless of whether you have a registered account, ScientiaMobile reserves the right to track usage associated with your domain via beacon signals fired by the WurflRTD module. This tracking is based on domain-level beacon data and does not involve the collection of personal data about your end users beyond what is described in Section 5.

3.3 Commercial Access

To access commercial tiers, contact ScientiaMobile. A registered account and separate commercial agreement will be required.

4. BEACON DATA COLLECTION

4.1 What Beacons Collect

The Service uses HTTP beacons to transmit aggregated auction performance data to ScientiaMobile’s backend infrastructure after each page auction completes. Each beacon payload may include:

Your domain name and page path
A WURFL device identifier associated with the visiting device
The enrichment level applied to the auction
A consent class value derived from Prebid.js consent signals (see Section 5.2)
Per-bidder CPM data and win/loss outcomes for each ad unit on the page
A sampling rate indicator where beacon demultiplying is active

Beacons do not contain end-user identifiers, names, email addresses, or any other directly identifying personal data.

4.2 Purpose of Beacon Data

ScientiaMobile uses beacon data to: measure the CPM uplift attributable to device intelligence enrichment; monitor quota usage and enforce access limits; generate aggregated performance analytics for your use and for ScientiaMobile’s own service improvement; and identify publishers who may benefit from commercial access.

4.3 Retention and Aggregation

Raw beacon data is aggregated and anonymized. Raw data may be retained for a maximum of 8 weeks for security and auditing purposes. Aggregated data may be retained indefinitely for service analytics and reporting purposes. ScientiaMobile does not sell raw beacon data to third parties.

5. PRIVACY AND DATA PROTECTION

5.1 Device Detection Data

The Service processes HTTP request headers — specifically User-Agent strings and UA Client Hints — solely for the purpose of device detection. This processing is carried out on the basis of legitimate interest in providing the Service. IP addresses are, where required by applicable law to be treated as personal data, retained for up to 36 months for fraud detection, invalid traffic prevention, and security purposes, then permanently redacted. Access to IP address data is restricted to authorized security personnel.

5.2 Consent Class

WurflRTD derives a simplified consent classification value (“consent class”) from Prebid.js’s normalized consent signals. This value is a non-identifying integer (0 = no consent or opt-out, 1 = partial or ambiguous consent, 2 = full consent or non-GDPR region) used solely for aggregated analytics segmentation. Raw consent strings are not accessed, stored, or transmitted by the Service.

5.3 Your Obligations as Publisher

You are responsible for ensuring that your deployment of WurflRTD complies with applicable privacy law, including GDPR, UK GDPR, and CCPA/CPRA. In particular, you must: maintain an accurate privacy policy that discloses the use of device detection services and third-party data processors on your website; ensure that your Consent Management Platform (CMP) is configured in a manner consistent with these data practices; reference ScientiaMobile’s privacy notice for publishers, available at https://www.scientiamobile.com/wurflrtd-privacy-policy/; and where the strictly necessary exemption for localStorage access under ePrivacy Directive Article 5(3) or equivalent national rules does not apply in your jurisdiction, your Consent Management Platform is configured to obtain appropriate consent before WurflRTD is initialized.

5.4 No Personal Data Sale

ScientiaMobile does not sell personal data. ScientiaMobile does not build user profiles. ScientiaMobile does not perform cross-site tracking of your end users.

5.5 Data Processing Agreement

Where required by applicable law — in particular where you are subject to GDPR — you may request a Data Processing Agreement (DPA) from ScientiaMobile by contacting privacy at scientiamobile dot com. Execution of a DPA is required for commercial-tier customers in GDPR-regulated jurisdictions.

6. INVALID TRAFFIC

You agree that you will not, and will not permit any third party to, directly or indirectly generate impressions, clicks, or other ad interactions through any means that are coercive, incentivized, misleading, automated, or fraudulent, including through bots, macro programs, or internet agents; blind links where end users do not know they are performing an action; requiring an end user to interact with an ad in order to obtain some other benefit; or any other method that causes ad interactions to fail to represent genuine human engagement. ScientiaMobile reserves the right to suspend or terminate your access to the Service immediately and without notice if invalid traffic originating from your domain is detected.

7. INTELLECTUAL PROPERTY

7.1 ScientiaMobile’s Rights

The Service, WURFL.js, all device capability data, and all associated software and infrastructure are and remain the exclusive intellectual property of ScientiaMobile. These Terms grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Service solely for the purposes described herein and subject to the access limits applicable to your account. No other rights are granted. You may not reverse engineer, decompile, copy, modify, or create derivative works from the Service or any data it delivers.

7.2 Your Rights

You retain all rights to your website, your ad inventory, and your aggregated performance data. ScientiaMobile does not claim any ownership over your publisher data.

7.3 Feedback

If you provide ScientiaMobile with feedback, suggestions, or ideas regarding the Service, ScientiaMobile may use that feedback freely and without obligation to you.

8. RESTRICTIONS

You agree that you will not:

Deploy WurflRTD on domains you do not own or control.
Resell, sublicense, or otherwise make the Service available to third parties as a service bureau arrangement, except as expressly contemplated by a commercial tier agreement.
Circumvent or attempt to circumvent usage limits, for example by manipulating localStorage values or spoofing domain identifiers.
Use the Service in a manner that facilitates a denial of service attack against ScientiaMobile or any third party.
Use the Service for any purpose that violates applicable law, including privacy law, consumer protection law, or export control regulations.
Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.

9. TERM AND TERMINATION

9.1 Term

These Terms take effect upon your first deployment of WurflRTD and continue until terminated as described below.

9.2 Termination by You

You may terminate your use of the Service at any time by removing WurflRTD from your Prebid.js configuration. For commercial-tier customers, termination is also subject to the terms of your commercial agreement.

9.3 Termination or Suspension by ScientiaMobile

ScientiaMobile may suspend or terminate your access to the Service at any time: if you materially breach these Terms and fail to cure the breach within ten (10) days of written notice; immediately if you repeatedly breach these Terms; immediately if your usage poses a security risk, causes infrastructure harm, or involves invalid traffic as described in Section 6; or for any reason with thirty (30) days’ notice for free-tier publishers.

9.4 Effect of Termination

Upon termination, your license to use the Service ends immediately. Beacon data already collected will be handled in accordance with Section 4.3. Sections 5, 6, 7, 8, 11, and 12 survive termination.

10. DISCLAIMERS

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. SCIENTIAMOBILE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM INACCURACIES. DEVICE CAPABILITY DATA IS PROVIDED ON A BEST-EFFORT BASIS AND MAY NOT BE ACCURATE IN ALL CASES. SCIENTIAMOBILE DOES NOT WARRANT THAT USE OF THE SERVICE WILL RESULT IN ANY PARTICULAR CPM IMPROVEMENT OR REVENUE OUTCOME.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCIENTIAMOBILE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF PROFITS, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SCIENTIAMOBILE’S TOTAL AGGREGATE LIABILITY TO YOU UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SCIENTIAMOBILE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

12. GENERAL

12.1 Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms shall be brought exclusively in the courts of the Commonwealth of Virginia, and each party consents to the personal jurisdiction of those courts.

12.2 Changes to These Terms

ScientiaMobile may update these Terms from time to time. For free-tier publishers, updated Terms take effect thirty (30) days after being posted to https://www.scientiamobile.com/wurflrtd-terms-of-service/ .

Continued use of the Service after that date constitutes acceptance of the updated Terms. For commercial-tier customers, changes are governed by your commercial agreement.

12.3 Entire Agreement

These Terms, together with any applicable commercial agreement and the DPA (where executed), constitute the entire agreement between you and ScientiaMobile with respect to the Service and supersede all prior understandings relating to its subject matter.

12.4 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

12.5 No Waiver

ScientiaMobile’s failure to enforce any provision of these Terms shall not be construed as a waiver of its right to do so in the future.

12.6 Assignment

You may not assign your rights or obligations under these Terms without ScientiaMobile’s prior written consent. ScientiaMobile may assign its rights under these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.
